Terms of Service

1. Acceptance of Terms

By accessing or using FitManager ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

FitManager is a multi-tenant SaaS platform that provides gym management tools including member management, access control, point-of-sale functionality, reporting, and public-facing gym websites. The Service is provided on a subscription basis.

3. Accounts and Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it up to date.

4. Subscriptions and Billing

Access to the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' written notice.

5. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe the rights of any third party; (c) transmit any harmful or malicious content; (d) attempt to gain unauthorised access to any part of the Service; or (e) interfere with the operation of the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of member data collected through the Service complies with applicable data protection laws.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by FitManager and are protected by applicable intellectual property laws. You retain ownership of any data you input into the Service.

8. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will cease at the end of the current billing period. We reserve the right to suspend or terminate accounts that violate these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, FitManager shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
